Invitation for Expressions of Interest (“IEOI”) for ACC’s Hybrid Graphics Package for Asia Cup 2022 (Men’s and Women’s)

  1. The Asian Cricket Council FZ-LLC (“ACC”) invites third parties to express their interest (“EOI”) in acquiring the rights and obligations to provide hybrid graphics (the “Hybrid Graphics Package”) during the live production of: (i) the ACC T20 Asia Cup 2022 – Men’s (“Men’s Asia Cup”) to be held from 27th August 2022 to 11th September 2022; and (ii) the ACC T20 Asia Cup 2022 – Women’s (“Women’s Asia Cup”) to be held in October 2022 (collectively the “Tournaments”).  This IEOI aims to identify those desirous parties who are interested to exploit the Hybrid Graphics Package being offered,  on the terms and conditions that will be more particularly detailed in the agreement to be executed between ACC and the successful interested party (“Agreement”) as a product of this EOI process.
  2. To clarify, the Hybrid Graphics Package will mean the rights and obligations associated with providing brand logo usage on graphics (including statistical information and commercial identifications) inserted into the Tournament feed. To illustrate, the graphics being referred to here are brand logo integrated cricket asset graphics such as speed ball, DRS, hawkeye, speed tracker etc. Further specifics relating to the Hybrid Graphics Package and the limitations applicable will be discussed after the submission of EOIs, with each eligible interested party which has submitted an EOI.
  3. Interested parties to note that the annual turnover of the interested party submitting their EOI must be a minimum of USD 1,000,000.00 (United States Dollars One Million only) as per the interested party’s last audited accounts. Notwithstanding anything contained herein, ACC reserves the right to add, delete, modify the eligibility and/or other criteria for interested parties at any point of time in this EOI process.
  4. Each interested party is required to respond with its EOI through the submission of this EOI Form, duly filled and signed by its authorised signatory (including all Annexures and supporting documentation). Interested parties can download the EOI Form by clicking here.
  5. Interested parties need not include any indicative level of fees that will be offered for licensing of the Hybrid Graphics Package in their EOIs.
  6. Neither the publication of this document nor any part of its content is to be taken as any form of offer capable of acceptance or any commitment or acknowledgment on the part of ACC to proceed with any EOI of any interested party and ACC reserves the unfettered right not to grant the whole or part of the Hybrid Graphics Package without giving any reasons and/or to make alternative arrangements for the same. The ACC reserves the right to inform the interested parties of the eligible/successful interested party(ies) as a result of this EOI process.
  7. At any time prior to the last date for submission of EOIs, the ACC may at its sole discretion, modify, add or alter the terms in, nature and/or the conditions of this IEOI (including the deadline for submission), without any obligation to provide reasons.
  8. Interested parties shall remain responsible for obtaining all further information, at their own cost, that they consider necessary or expedient for the purpose of submitting their respective EOIs and will be deemed to have done so before submitting the same.
  9. The ACC reserves the right, to be exercised at its sole discretion, to request further information from any interested party and the replies to any such request shall be deemed to form part of their EOI.
  10. Each interested party is solely responsible for all costs, expenses and liabilities incurred by it in: (i) the preparation and submission of its EOI; (ii) making necessary enquiries and obtaining any information for the preparation and submission its EOI; and (iii) responding to requests for further information by the ACC.
  11. All information (written or oral) and documents that are furnished by either the ACC or the interested party as a part of this EOI process, will be treated as strictly confidential and shall not, unless required in accordance with law, be disclosed to any other party.
  12. The information set out in this IEOI is in summary form and does not purport to contain complete descriptions of the arrangements relating to the Hybrid Graphics Package, all of which may be subject to change and amended by ACC in its discretion.
  13. Each interested party and recipient of this IEOI shall be responsible for verifying the accuracy of all information contained herein and making enquiries necessary. This IEOI does not contain any warranty, assurance or representation of any kind upon which any interested party is entitled to rely at any point in time whether in order to bring any claim, action or proceedings of any kind against the ACC or any other person (including without limitation for misrepresentation, omission and/or breach of any duty) or otherwise.
  14. No interested party shall have any cause of action or claim against ACC or any other person for the annulment or termination of the EOI process or rejection of its EOI.
  15. Any wrong or misleading information, including the concealment of any material fact by or on behalf of any interested party may, at ACC’s discretion and without prejudice to ACC’s other rights and remedies, lead to disqualification of the interested party.
  16. For the avoidance of doubt, it is clarified that ACC shall not be obliged to award the Hybrid Graphics Package to the interested party which indicates willingness to pay the highest fees in the EOI process. ACC reserves the right to accept or reject any EOI received as a response to this IEOI at its sole discretion, without assigning any reason whatsoever.
  17. Neither ACC nor its officers, employees and/or agents shall, in any circumstances whatsoever, be responsible or liable in any manner or mode by whatever name called or described for any costs, liabilities, losses, damages or expenses of any kind whatsoever incurred or suffered in connection with this document or as a consequence of the preparation or delivery of any EOI.
  18. All matters in relation to this IEOI or the process shall be governed by the laws of Dubai, UAE any disputes shall be subject to the exclusive jurisdiction of the courts at Dubai, UAE.
  19. Each EOI must be delivered by email to the following addresses:  [email protected] and [email protected] with the subject line “EOI – Hybrid Graphics Package – Asia Cup 2022 (Men’s and Women’s)”and must be received by 5:00 pm (Dubai Time) on 15th July 2022. ACC reserves the right to not consider any EOIs received after this deadline.
  20. Post-delivery of the EOI, ACC reserves the right inform eligible interested parties of the details of the Hybrid Graphics Package and restrictions and also the next steps to be undertaken.
  21. The timelines appearing in this IEOI is subject to revision by the ACC at any point of time and at its sole discretion.

  1. To clarify, the Public Exhibition Rights e. the Rights, will mean all rights to transmit, by means of any media whatsoever, any audio-only, still or moving visual-only or audio-visual material, data and/or textual material (including the feed and footage of, and/or relating to, any of the Tournament matches (or any part thereof)) for exhibition to an audience by means of any television set and/or conventional home and personal radio receiver located anywhere in cinemas, stadia, water borne vessels, buses, trains, any other place other than a private dwelling, armed services establishment, hospital, bar, hotel, restaurant, airport, railway station, shopping mall, office, construction site and oil rig; and all rights to exploit any and all commercial opportunities arising from, and/or in connection with, the transmission and/or exhibition of such material. Further specifics relating to such Rights and the limitations applicable will be discussed with each eligible interested party having submitted an EOI, after the submission of EOIs.
  3. Interested parties who are keen to acquire these Rights by way of licensing can do so on a global or country-specific basis, which must be specified in the EOI submitted.
  4. To clarify, the Rights in relation to the Men’s Asia Cup are available for exploitation only from the day of the first Match of the said Tournament up until the day of the last Match of the same. Similarly, the Rights in relation to the Women’s Asia Cup are available for exploitation only from the day of the first Match of the Tournament up until the day of the last Match of the same.
